Notice of Public Hearing - April 1, 2026

Notice is hereby given that the Board of County Commissioners will hold a Public Hearing April 1st, 2026 at 6:00 PM at the Lewis County Courthouse in Nezperce, Idaho for the Proposed Ordinance of the County of Lewis, Idaho, pursuant to Idaho Code Section 67-6526 providing for application of plans and ordinances for the Area of City Impact.

ORDINANCE 2026-01

                AN ORDINANCE OF THE COUNTY OF LEWIS, IDAHO PURSUANT TO IDAHO CODE SECTION 67-6526, PROVIDING FOR APPLICATION OF PLANS AND ORDINANCES FOR THE AREA OF CRAIGMONT CITY IMPACT.

                WHEREAS, pursuant to Idaho Code Section 67-6526, the County of Lewis, Idaho and the City of Craigmont, has conferred and negotiated in good faith upon an Area of City Impact for the City of Craigmont within the unincorporated area of Lewis County; and

                WHEREAS, the County of Lewis has previously adopted Ordinance 2002-04, establishing an Area of Craigmont City Impact;

                WHEREAS, The City of Craigmont has previously adopted Ordinance 289 and, pursuant to the five-year review requirement of I.C. § 67-6526, has adopted Ordinance 457 which re-affirmed the Area of City Impact boundaries previously set and found them “to remain appropriate, consistent with the City's Comprehensive Plan, and in the best interest of the public health, safety, and welfare”;

                WHEREAS, following a public hearing with notice as provided by I.C. § 67-6509, the Board of County Commissioners also finds that the boundaries set forth below are consistent with the criteria set forth in I.C. § 67-6526(1)(b);

                NOW THEREFORE, BE IT ORDAINED, by the Commissioners of the County of Lewis, Idaho as follows:

Section 1.

                Within the designated Area of City Impact, the building code of the City of Craigmont shall apply, which is the Uniform Building Code, as currently adopted or subsequently amended. Lewis County shall be responsible for all phases of administration and enforcement of such Code, including issuance of permits and inspections.

Section 2.

                Within the designated Area of City Impact the subdivision ordinance of the City of Craigmont shall apply, as currently adopted or subsequently amended. The City of Craigmont shall be responsible, if it so elects, for reviewing, commenting upon, and endorsing applications for subdivisions within this geographic area. Lewis County shall be responsible for all phases of the applications, administration and enforcement of the applicable subdivision ordinance and will make all final decisions in regard to subdivisions within the Area of City Impact. The Lewis County Commissioners may request that applications and requests regarding subdivisions within this area be reviewed by the City, where such review and comment appear warranted and would be of assistance in the rendering of a final decision

Section 3.

                Within the designated Area of City Impact, the existing Lewis County Comprehensive Plan and Land Use Ordinance as currently adopted, or subsequently amended shall continue to apply, until such time as the City of Craigmont shall establish a City Comprehensive Plan and/or Zoning ordinance, at which time it shall be mutually agreed upon by the County and City which entities plan or ordinance shall apply.

Section 4.

                Within the designated Area of City Impact the Lewis County Comprehensive Plan, Land Use Ordinance and all Land Use Special Permits shall apply. All requests for development, zone change, conditional use permit, or variance within the Area of City Impact shall made pursuant to the Lewis County Zoning and Development Ordinance, as currently adopted or subsequently amended. Prior to any action being taken on such request the City of Craigmont; if it so elects, shall review, comment upon, and issue an endorsement of the request as submitted. The Lewis County Commissioners shall make all final decisions in regard to subdivision plats, as well as request for development, zone change, conditional use permit, or variance with City Impact.

Section 5.

Lewis County Ordinance #2002-04, providing for application of plans and ordinances for the Area of Craigmont City Impact and all other ordinances or parts of ordinances in conflict herewith, are hereby repealed.

Section 6.

This Ordinance shall take effect and be in full force upon its passage, approval and publication in one issue of the Lewis County Herold, a newspaper of the County of Lewis.

Section 7.

That the Area of City Impact for the City of Craigmont within the unincorporated area of Lewis County is particularly described as follows, to wit:

Section 30: South East Quarter
Section 31: East Half
Section 32: All
Section 33: All
Section 34: All

Township 33 North, Range 1 West B.M

and the same is shown on the attached map, which is adopted in conjunction with this Ordinance and is intended to be in integral part of said Ordinance.

PASSED UNDER SUSPENSION of all rules and regulations of this County Commission upon which proper roll call votes were duly taken and entered as an ordinance of this County at a special meeting of the Commissioners of the County of Lewis, held on the 1st day of April 2026.
