NOTICE OF PUBLIC HEARING

Notice is hereby given that pursuant to Idaho Code §67-6512, in accordance with the notice and hearing provisions provided under section 67-6509, Idaho Code, and Lewis County Zoning and Development Ordinance #97-2, that the Lewis County Planning and Zoning Commission will hold a Public Hearing on Wednesday, November 13th, 2024, at 7:30 pm. at the Lewis County Courthouse, 510 Oak Street, Nezperce, Idaho.  Public comment is being sought on the following:

  • Conditional Use Permit 2024-03: Dean Mosman, Mosman Farmland and Mosman Landholdings LLc have requested a Conditional Use Permit for parcel numbers RP35N01E050110, RP35N01E041220, RP36N01E330102, and RP36N01E330300 approximately 217 acres, 176 acres, 190 acres and 10 acres, respectively, for facilitating a yearly ranch rodeo and music festival that will be held over a period of two days on Goin Rd. and Central Ridge Rd. in Craigmont, Idaho.

Situated in Lewis County, State of Idaho, to wit:
A tract of land, Section Five (5), Township Thirty-five North (35N), Range One (1) East, Boise Meridian, 217 acres Lots 1-2, S1/2NE, N1/2SE (Less Tax #C-63) Lewis County Idaho.

A tract of land, Section Four (4), Township Thirty-five North (35N), Range One (1) East, Boise Meridian, 176 acres, SENW, SWNE, N1/2NWSE, W1/2NW & Tax # C-32 (Less Tax #C-66 IN NENW) Lewis County Idaho.

A tract of land, Section Thirty-three (33), Township Thirty-six North (36N), Range One (1) East, Boise Meridian, 190 acres, SENW, NE (Less Tax #C-55) (10AC) Lewis County Idaho.

Written Testimony will be allowed if received by 5 p.m. Tuesday November 12th, 2024, in the Planning and Zoning Office. These Public Hearing is being held to address Conditional Use Permit 2024-03 for Dean Mosman, Mosman Farmland and Mosman Landholdings LLC.

The Chairman would like to remind everyone to please stand and wait to be recognized, state your name and where you are from before giving testimony. If you do not wait to be recognized your comments may not become part of the public record.

Commission members may, at any point during the hearing, direct questions germane to the hearing to the Chairman, other ex-officio members, the applicant, and citizens, but must refrain from debate until close of public comments.

Commission members will declare conflicts-of-interest, if any, at this time.

THE HEARING PROCEDURES

The purpose of a public hearing is to give everyone an opportunity to offer their views and provide evidence in support of their views.  This body of opinion and evidence creates the record upon which the Lewis County Planning and Zoning Commission rely on for their findings and conclusions.  Opinions expressed and evidence offered “off the record” cannot be accepted because they may impair the fairness of the decision-making process.  Your cooperation in keeping this process fair and orderly will be appreciated.

  • PRIOR TO OFFERING TESTIMONY:  Persons wishing to offer written and/or oral testimony on any item discussed at the public hearing must provide their name, address and telephone number on the attendance record provided on the table by the door.
  • TO OFFER WRITTEN AND/OR ORAL TESTIMONY: Stand to be recognized by the Commission Chairman, give your name, mailing address and, if applicable, the organization you are representing.  Then present your testimony.  The Commission reserves the right to set a time limit of three minutes on testimony and to prohibit repetitive testimony.
  • TO ASK A QUESTION: Time will be allotted for the public to ask questions.  Signal the Commission Chairman by raising your hand and wait to be recognized.  Members of the Commission may ask questions at all times and after each witness.
  • Members of the Lewis County staff will pass out an INFORMATIONAL PACKET ON THE PROPOSED REQUESTS.
  • Once written and oral testimony has been accepted into the record by the Commission Chairman and a final call for questions and testimony from members of the audience have been received, the Commission Chairman will announce the next steps in the decision-making process and close the hearing.

  • Deliberations by the Planning and Zoning Commission will take place during the regular portion of the monthly meeting and the deliberations will be subject to open meeting laws, but will not constitute a "Public Hearing."
  • When deliberation is complete, the Chair will entertain a motion, to either approve the application, approve subject to modifications as it deems necessary, or deny the application.
  • The Lewis County Planning and Zoning Commission is an advisory commission to the Lewis County Commissioners.  The final decision will be made by the Lewis County Commissioners.
